Waitangi Day - special rules for the public holiday

Waitangi Day is always the 6th of February. The day of the week that this falls on changes by year, and there are special rules for this public holiday.

  • When Waitangi Day falls on a weekday (Monday to Friday), that day is treated as a public holiday.
  • When Waitangi Day falls on a weekend (Saturday or Sunday) and your employee does not usually work on that day, the holiday transfers to the following Monday.
  • When Waitangi Day falls on a weekend (Saturday or Sunday) and your employee usually work on that day, that day is the holiday for them.

The rules for Waitangi Day are set out in section 45A of the Holidays Act 2003.
